Why Patient Rights Advocacy is Urgently Needed in Nepal

While the Constitution of Nepal recognizes health as a fundamental human right, patients and families across both public and private hospitals frequently encounter severe barriers to dignity, transparency, and justice.

Informed Consent Disregard

Consent forms are frequently printed in English or legalistic jargon, signed under extreme distress moments before surgery without verbal counseling or alternative explanations.

Emergency Denial & Deposits

Despite constitutional guarantees under Article 35, critically ill trauma or obstetric patients are regularly denied emergency admission until cash deposits are produced.

Opaque Billing & Retentions

Lump-sum hospital bills, medicine markups exceeding official MRPs, and unlawful detention of impoverished patients or deceased bodies remain distressing occurrences.

Absent Grievance Recourse

Most hospitals lack functioning patient grievance desks. When tragic outcomes occur, the lack of transparent dialogue frequently leads to destructive physical clashes.

Voluntary Informed Consent

No surgery, invasive test, or clinical trial can be performed on you without voluntary consent under Section 11 of the Public Health Service Act 2075. You hold the unconditional right to seek a second medical opinion.

Right #6 • १०% निःशुल्क कोटा

Itemized Billing & 10% Quota

Right to receive an itemized receipt before paying. Under Health Institution Operation Standards 2077, private hospitals must reserve 10% of beds for free care of indigent citizens.
